www.mariamasoud.com is operating a website (hereinafter referred to as “the website)” dedicated to women’s clothing and accessories, hereafter referred to as “Product(s)”). www.mariamasoud.com offers services (hereinafter referred to as “the Services”) through which you may purchase items that are displayed on our website.

These terms and conditions shall govern the relationship between the Clients (hereinafter referred to as “Clients”, “Customers” or “You”) and www.mariamasoud.com when using its services. These Terms and Conditions may be amended and updated from time to time, without any prior notice, and become effective once they have been posted on our website. The prices on our Website include VAT. Additional costs can be expected, as shipping and insurance costs are not included in the original listed item price. The shipping cost is calculated in function of the purchased item and the geographical location of the User. The insurance cost, calculated based on the value of the item being shipped, is included in the shipment cost displayed on the website.

www.mariamasoud.com tries to always be as precise and accurate with prices, nevertheless, errors can happen, which will be rectified and corrected to the best of our capacity and in the shortest time.

By using our Website, the Client accepts that prices displayed on our website may vary from the prices displayed in our physical boutique. www.mariamasoud.com reserves the right to change at any time the prices offered on its website. It shall not be liable to you or any third-party for such price change or for removing one of its items from the website.

Prices for our products are subject to change without notice. 

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

Prior to placing an order:

To be able to use our Website, the client must register an account and enter all relevant information as requested during the order process and account registration process, including information relevant to Customer’s identity, address, payment details and all other information requested.

The Customer engages to provide the personal information as requested, as accurately and honestly as possible. Should a change in this information occur, the Client agrees to update them including your email or billing address. www.mariamasoud.com reserves the right to terminate all relation to any Client, and forbid them of using the Services of the Website again, should the Client provide false information and shall initiate any legal actions deemed appropriate against the Client if such an incident were to occur.

A confirmation email will be sent to the email that the Client has entered and given to www.mariamasoud.com, and the order shall be processed imminently after . Your order will only be confirmed once your payment details have been authorized and when the funds reach our trading account.

V. Products

www.mariamasoud.com holds the right to remove whichever product from this website at any time and/or to remove or modify materials or content from this website.

www.mariamasoud.com strives to process every order, however there may be unexpected circumstances, which may result in the refusal to process an order after we sent you an order confirmation. We reserve the right to do this at our own discretion.

www.mariamasoud.com is entitled to refuse a transaction without providing a justification. We may, at our sole discretion, limit or cancel quantities purchased and will notify the Client by email, upon such an occurrence. If the Client has made a payment and the transaction is cancelled, the refund to the Client shall follow according to our refund policy.

We are not liable towards you or any other third party because of the fact that we have removed a product from this website, irrespective of whether it has been sold or not, nor for the removal or modification of materials or the content of this website.

www.mariamasoud.com is offering items and products for sale on this website, these items may have a limited quantities and we may at any time withdraw products from sale, or cancel an order when such items are not available anymore in our store. We do not hold any responsibility for such an occurrence.

www.mariamasoud.com provides details and descriptions of the items displayed on our website including size, manufacturing material or brand. However, the appearance of the items’ images may be different than the reality due to your computer or mobile screen. We therefore cannot guarantee the 100% accuracy of the Product Colour, Fitting or Feel.

Upon receiving the Product and shipment, the Customer should check and verify the by the state of the Product, in order to refuse the goods in case of damage. If the goods show any defects or damage, the Customer must notify us immediately upon receipt of the shipping parcel, and can return the goods in accordance with our return & refund policy.

VI. Shipping

www.mariamasoud.com will try to commit to process the Customer’s order within fifteen (15) business days after the date of the order confirmation. Beyond this period, the Customer is entitled to cancel your order and ask for the refund of your purchase in accordance with our Refund policy.

The shipment will be made according to the shipment details you have provided when placing your order. www.mariamasoud.com shall not in any case, be responsible, for any mistakes made by the Customer when providing his/her shipping information. All costs incurred by such mistakes shall be at the customer’s expense and will be charged on your credit card when applicable.

www.mariamasoud.com has partnerships with courier delivery service companies, which include Colissimo, DHL and UPS for your shipment. Shipment price and time depend on the weight of the Product and delivery method selected. Shipments are tracked, insured and require the Customer signature confirmation upon delivery.

The risk for the products is for you from the moment of delivery.

The ownership of the products is only transferred to you when we have received full payment or all due amounts with regard to the products, inclusive of delivery costs, or after delivery (as defined in article 7 above), should this be later.

VII. Returns and refund policy

www.mariamasoud.com accepts all returns of all purchased items on its website subject to the condition that the items are identical to the product description, and in impeccable condition.

Any Products returned that are damaged, or require treatment and washing, www.mariamasoud.com reserves the right to charge the Customer’s card on record for the inconvenience.

www.mariamasoud.com tags are placed on the Products, and should be kept on the piece of clothing to be eligible for a return. Any Returned items whereby the Tag has been removed, shall not be refunded.

Should a Client seek to process the Return , they can do so within the period seven (7) days to us by using the Return information in the shipped package and sending this back to us. The Client shall send the product in the same package as they have received it. Products that are not in the same state as the state of delivery or that have been used and not only opened, are strictly not exchanged or refunded.

Returns’ Shipping is not covered by www.mariamasoud.com. For further information you can contact us at info@mariamasoud.com.

If you are based in Monaco, you can make the return directly in our Physical Boutique at the address of EDEN Monte-Carlo, Le Metropole Shopping, 17 Avenue Des Spelugues, Monaco, 98000.

After we received the Product return, we will verify its condition and see if it eligible for a return, and if verified, we will process your refund within thirty (30) days. Refunding takes place to the source of payment that the Product was bought for.

If it is to exchange the good, the Customer can apply for a store credit, and make the return.

Return of defected products: www.mariamasoud.com checks all Products before they are shipped and verifies the perfect and new condition of the Product, if you are of the belief that a Product is damaged or defected, please contact us at info@mariamasoud.com, mentioning your order number and a description of the damage or defect. If we approve a return of a defected Product, we will cover the shipping costs.

After receipt of the returned product we will inspect it completely and notify you within a reasonable time period via e-mail about your right to replacement or refund (if applicable). We strive to process the refund or replacement within thirty (30) days after our confirmation to you by e-mail, whereby you have the right to a refund or replacement of the non-conforming product.

If a defect exists, then the defective products will be fully refunded, inclusive of a refund of the delivery costs and all costs that you have reasonably made to return the item.

These stipulations do not affect your lawful rights under the regulations in force.

Our online e-commerce platform provides the Customer with a direct payment gateway. When placing your order, you may chose among different payment methods via debit or credit card. Should you wish to pay via bank transfer for an item, please contact info@mariamasoud.com.

You can pay with Visa, MasterCard and American Express. In order to minimize the risk of non-authorized access, the data of your card are encoded.

On the moment that we receive your order, we execute a pre-authorization on your credit card to establish whether there are sufficient funds to complete the transaction.

The amount is debited to your card on the moment that your order leaves the warehouse.

By clicking on “Authorize payment”, you confirm that the credit card is yours.

Credit cards are subjected to validity checks and permission by the provider of your credit card.

If we do not receive the desired permission, then we are not liable for a possible delay or non-delivery and we are not able to enter into a contract with you.

X. CUSTOMS AND TAXES

Upon ordering with www.mariamasoud.com, the Customer and person receiving the Product(s) will be the responsible importer and must to fully comply with the laws and regulations of the country of destination.

For orders outside the European Union, the Client’s country of destination may be subject to import taxes and customs duties. If any, the Client is entirely responsible for any additional costs related to customs, taxes and duties of importing the Product to the destination country. www.mariamasoud.com takes no responsibility for these additional costs, and suggest the Client contacts their Customs Office to review any costs related to placing the Order.
